The Ventura Group, consisting of Ventura Motors Pty Ltd ACN 004 235 518 and its subsidiaries (“Ventura“, “we“, “our” or “us“), operate bus and coach services in Melbourne. We are the leading provider of public transport in Melbourne and pride ourselves on providing dependable, friendly and sustainable bus services.

Ventura also operates a website under the domain name www.venturabus.com.au (“Website“).

We recognise the importance of maintaining the privacy of the personal information of our customers, visitors to our Website and other individuals we deal with.

This Privacy Policy applies to the collection, use and disclosure of personal information by Ventura, and is made in accordance with the Australian Privacy Principles which apply to Ventura pursuant to the Privacy Act 1988 (Cth) (“Privacy Act“).

You agree to the terms of this Privacy Policy by your use of the Website.

In the event of inconsistency between this Privacy Policy and the Privacy Act, the Privacy Act will prevail.

How is personal information collected by Ventura?

Ventura primarily collects personal information about individuals:

  • who contact us with an enquiry, feedback or complaint, so that we can answer the query or investigate and resolve the complaint;
  • who make a booking with us for a charter service;
  • who apply for employment with Ventura, so that we can assess their suitability for vacant positions within our organisation; or
  • when we issue an infringement notice to them pursuant to the Transport (Compliance and Miscellaneous) Act 1983 (Vic).

We will take reasonable steps to notify individuals about our collection of their personal information, and will provide all relevant information prescribed under the Privacy Act.

We will only collect personal information by lawful and fair means. We will destroy or de-identify any personal information we receive if we would not ordinarily be permitted to collect that information under the Privacy Act.

What kinds of personal information are collected by Ventura?

The personal information we may collect about individuals includes:

  • name;
  • general contact information such as address, telephone, fax and email; and
    other details relevant to the reason the information is being collected, such as:
  • the details of an enquiry, complaint or feedback;
  • the details of a charter booking, and the customer’s payment information;
  • details relevant to a person’s employment application, such as work experience, qualifications and referees; or
    the circumstances of the infringement.

How is personal information used by Ventura?

When we collect personal information about an individual, we will not use that information for any purpose other than the primary purpose for which it is collected, except as otherwise set out in this Privacy Policy or as permitted or required by the Privacy Act.

How is personal information disclosed by Ventura?

If we issue an infringement notice, personal information contained in the notice is disclosed to the Victorian Department of Transport, Planning and Local Infrastructure, State Government of Victoria (or its successor body) as required by law.
Other than as set out above, Ventura does not use or disclose any information about individuals without their consent, except as otherwise required or permitted under the Privacy Act.

We do not disclose personal information to any recipients located outside Australia.

Does Ventura use personal information for direct marketing communications?

If your personal information was collected for the purposes of you making a charter booking or enquiry about charter services, we may contact you using the contact details which you provide to us in order to provide you with further information about charter services and other products and services you may be interested in.

We will comply with our obligations under Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth) in relation to such direct marketing communications.

Terms & Conditions - Ventura Free Charter Transfer Lottery

1. DEFINITIONS AND INTERPRETATION

1.1 Definitions

In these Terms unless the context otherwise requires:

    1. “Booking” means a booking for a Return Transfer;
    2. “Draw” means the lottery draw to determine a Winner as described in clause 5.1;
    3. “Entrant” means any party who is entered into the Promotion;
    4. “Eligibility Criteria” means the criteria described in clause 3.1 of these Terms;
    5. “Prize” means the prize described in clause 4 of these Terms;
    6. “Prize Draw Date” means each of the dates specified in Schedule 1;
    7. “Prize Value” has the meaning given in clause 4.1;
    8. “Promoter” means Ventura Transit Pty Ltd ACN 153 091 680 of 81 Cheltenham Road, Dandenong, Victoria 3175;
    9. “Promotion” means the Ventura Free Charter Transfer Lottery;
    10. “Promotion Period” means the period between 10 October 2023 and 20 December 2023;
    11. “Terms” means these terms and conditions;
    12. “Return Transfer” means a return bus transfer provided by the Promoter;
    13. “Winner” means an Entrant who wins the Promotion as determined in accordance with clause 5.

 

1.2 Interpretation

In these Terms unless the context otherwise requires:

    1. a word denoting the singular includes the plural and vice versa;
    2. a reference to a thing is a reference to the whole or any part of it, and a reference to a group of things is a reference to any one or more of them;
    3. all references to "$" and "dollars" are to the lawful currency of Australia;
    4. specifying anything after the words "including", "includes" or "for example" or similar expressions does not limit what else is included unless there is express wording to the contrary; and
    5. headings are for convenience of reference only and do not affect interpretation.

 

2. INTRODUCTION

2.1 The Promoter is running the Promotion in accordance with these Terms.

2.2 Each Entrant expressly acknowledges and agrees that the Promotion is subject only to these Terms. These Terms apply to the exclusion of any other terms that the Entrant seeks to impose or incorporate.

3. ENTRY AND ELIGIBILITY

3.1 Eligibility Criteria

A party shall be eligible for the Promotion when it makes a Booking within Victoria that:

    1. exceeds 3 hours;
    2. is made during the Promotion Period; and
    3. is completed or scheduled to be completed prior to 31 December 2023.

 

3.2 Entry

  1. A party who meets the Eligibility Criteria shall receive one entry into each Draw occurring after the date they first satisfy the Eligibility Criteria.
  2. If an Entrant meets the Eligibility Criteria in respect of more than one Booking throughout the Promotion Period, then that Entrant shall receive one further entry into the Draw for each additional occasion.

 

3.3 Free to enter

Provided that an Entrant meets the Eligibility Criteria, entry into the Draw is automatic, and no additional payment shall be required by the Promoter.

3.4 Making a Booking

A party may obtain a quote for and/or make a Booking by contacting the Promoter at:

4. PRIZE

4.1 Prize

The Prize awarded to each Winner shall be a free Return Transfer:

    1. for a duration of up to 8 hours; and
    2. for a maximum of 57 people,

 valued at $1,320 (“Prize Value”) and otherwise subject to the conditions contained in this clause 4.

4.2 Use of the Prize

The Winner may use the Prize:

    1. if payment has not been made in respect of the Winner’s Booking, then, at the Winner’s election:
      1. in respect of that Booking; or
      2. in respect of a new Booking; and
    2. if payment has been made in respect of the Winner’s Booking, then in respect of a new Booking,

 provided that if the cost of the Booking exceeds the Prize Value, the Winner shall be required to pay any excess amount.

4.3 Location

The Prize shall be for use exclusively within Victoria.

4.4 Expiry

The Prize must be redeemed within 90 days of being claimed in accordance with clause 5.3, unless extended at the sole discretion of the Promoter.

4.5 Not exchangeable

The Prize is non-transferable and non-exchangeable. No cash alternatives will be provided.

4.6 Substituted prize

The Promoter may substitute the Prize for an alternative where:

  1. the substituted prize is of a value that is the same or greater than the Prize Value and the Winner agrees in writing; or
  2. due to circumstances beyond the Promoter’s control, the Prize is unavailable, and reasonable attempts have been made to reach agreement with the Winner.

 

4.7 Final and binding decision

Subject to these Terms, the Promoter’s decision on any aspect of the Promotion, including the Prize, is final and binding.

5. DRAW

5.1 Selecting the Winner

At 10:00am on each Prize Draw Date, the Promoter will conduct a Draw to randomly select a Winner.

5.2 Publication of the result

  1. Each Draw will be posted on Facebook, available here https://www.facebook.com/venturabus/
  2. The Promoter will publish the identity of each Winner online at https://www.venturabus.com.au/charter-services for a period of at least 28 days.

 

5.3 Claiming the Prize

  1. On each Prize Draw Date, the Promoter will contact that Winner in writing via email using the address provided in connection with the Booking.
  2. If the Winner does not respond to the Promoter’s first email within 2 days, the Promoter will attempt to contact the Winner via email again.
  3. If the Winner has also provided a telephone number, the Promoter may attempt to contact the Winner via this number.
  4. To claim the Prize, the Winner must respond to an email sent under this clause or otherwise contact the Promoter using the details provided in clause 3.2.
  5. If the Winner does not claim the Prize within 14 days of the Draw, then then the Winner’s entry shall be deemed invalid, and clause 5.4 applies.

 

5.4 Substituted winner

  1. Where the Promoter has made reasonable efforts to contact a Winner, and these efforts have been unsuccessful, then the Promoter may, at its sole discretion, re- undertake the Draw and determine a substituted Winner.
  2. The Promoter must follow the process in clauses 5.2 and 5.3 in respect of any substituted Winner determined under this clause 5.4.

 

5.5 Attendance not required

Entrants are not required to attend the Draw to be eligible to win the Prize.

6. DATA PROTECTION AND PRIVACY

6.1 Use of information

Entrants agree that any personal information collected the Promoter in connection with the Promotion shall be used by the Promoter for the purposes of administering the Promotion and for the other purposes as specified in the Promoter’s Privacy Policy, available at https://www.venturabus.com.au/privacy-policy.

6.2 Updating information

An Entrant may access or update their information by contacting the Promoter at the details provided at clause 3.2.

6.3 Winner’s information

By entering the Promotion, each Entrant consents to their identity being published in accordance with clause 5.2 if they are a Winner.

7. LIMITATION OF LIABILITY

7.1 No liability

The Promoter shall have no liability for any damage, loss, injury, or disappointment incurred by any Entrant in connection with the Promotion or the Prize.

8. GENERAL

8.1 Variation or cancellation

The Promoter reserves the right, at any time and without prior notice, to cancel the competition or amend these Terms.

8.2 Governing law

These Terms shall be governed by the law of Victoria, Australia. The parties submit to the non- exclusive jurisdiction of the courts of Victoria.
